dc.description.abstractÖZET: Bugün, dünyada milyonlarca insan çeşitli nedenlerle göçmen konumundadır. Etnik çatışmalar, iç savaşlar, terör olayları, işsizlik, iklim ve çevre şartları gibi pek çok olumsuz durum ya da insanların daha iyi yaşam koşullarına erişme arzusu, insanları gönüllü ya da zorunlu olarak yerleşim yerlerinden ayrılmaya itmektedir. İnsanların bu konuma düşmesine neden olan durumlar ülkeden ülkeye değişebilmektedir. Ancak son iki yüz yılda göç hareketlerinin temel nedeninin ekonomik ve siyasal nedenler olduğu görülmüştür. İnsanlık tarihi kadar eski bir tarihe sahip olan göç hareketleri, bütün ülkeleri ilgilendiren uluslararası bir sorun olarak görülmektedir. Çalışma hakkı, ulusal ve uluslararası düzenlemeler kapsamında en temel insan haklarından birisi olarak kabul edilmektedir. Yabancılara tanınan söz konusu hakkın kapsamı ise ulusal mevzuatlardaki düzenlenişi itibariyle farklılık gösterebilmektedir. Özellikle zorunlu göç sonrası ortaya çıkan ani nüfus artışı ve bu nüfusun istihdam edilmesi, ülkelerin göç politikaları bakımından önemlidir. Her ülke, yabancıların çalışma hakkına ilişkin düzenlemeleri egemenlik ilkesine ve uluslararası hukuka uygun olma prensibine dayanarak gerçekleştirmektedir. Bunun yanı sıra yabancıların çalışma haklarının bazı ülkelerde dar yorumlandığı, bazı ülkelerde ise aşırı özgürlükçü yorumlandığı da görülebilmektedir. Araştırmanın amacı, Türkiye’deki yabancıların çalışma usulleriyle ilgili yasal düzenlemeler çerçevesinde, Suriye’den gelen, geçici koruma statüsüne sahip yabancılara tanınan çalışma hakkının ve istihdama erişimlerinin değerlendirilmesidir. Bu çalışmada temel olarak Türkiye’de geçici koruma statüsü altında olan Suriyelilerin çalışma hakları ve bu hak kapsamında onlara tanınan olanaklar incelenmiştir. Çalışmanın ilk bölümünde göç ve mültecilik olgusu, kavramsal olarak ele alınmıştır. İkinci bölümde geçici koruma statüsü altındaki Suriyelilerin iş gücü piyasasına katılımları ve yasal olarak sahip oldukları çalışma hakkına ilişkin ilkeler üzerinde durulmuştur. Üçüncü bölümde ise Türkiye’de geçici koruma statüsünde olan Suriyelilerin durumu açıklanmıştır.en_US
dc.description.abstractABSTRACT: Today, many negative situations such as ethnic conflicts, civil wars, unemployment, climate and environmental conditions force people to leave their settlements voluntarily or compulsorily. Today, millions of people are immigrants around the world. Situations that cause people to fall into this position may differ from country to country. However, in the last two centuries, it has been observed that the main reasons for migration movements are economic and political. Migration movements, which have a history as old as human history, are seen as an international problem that concerns all countries today. The right to work is recognized as one of the most fundamental human rights within the scope of national and international regulations. The scope of the aforementioned right granted to foreigners may differ in terms of regulations according to national legislation. Especially the sudden population growth after forced migration and the employment of this population are important for the migration policies of countries. Each country makes its regulations regarding the right of foreigners to work based on the principle of sovereignty and compliance with international law. In addition, it can be seen that the right to work of foreigners is interpreted narrowly in some countries, and in some countries extremely liberal. The aim of the research is in line with legal regulations on the foreigners working procedures, to evaluate Syrian’s working rights and accessing to the laber market in Turkey who are under temporary protection. This study is basically about working rights of Syrians under temporary protection status and the opportunities given to them under this status. In the first part of the study, irregular migration and the phenomenon of refugees are discussed conceptually. In the second part, the principles regarding to participation of Syrians in the labor market and their legal right to work are discussed. In the third part, it is described that the situaton of Syrians under temporary protection status in Turkey.en_US
