İşkence suçunda tipik fiil yönünden ‘acı ve ezanın ağırlığı’ ile suçun ‘sistematik ve belli bir süreç içinde işlenmesi’ ölçütlerinin değerlendirilmesi

Abstract

ÖZET: Öğretideki baskın görüşe göre 5237 sayılı Türk Ceza Kanunu’nda işkence suçunda tipik fiili karakterize eden olgu, madde gerekçesinden hareketle esas itibarıyla fiilin ‘sistematik bir biçimde ve belli bir süreç içinde işlenmesi’dir. İşkenceye Karşı Birleşmiş Milletler Sözleşmesi’nin tanımı ve bu tanımı esas alan Avrupa İnsan Hakları Mahkemesi (AİHM) içtihatlarından hareketle diğer bir yaklaşım ise, işkence suçunda ayırt edici özelliğin ‘acı ve ezanın ağırlığı’ kriteri olduğunu savunmaktadır. Fakat, her iki görüş de maddenin açık lafzına aykırı bir yorumu benimsemektedir. Diğer taraftan, Yargıtay da seçimlik hareketli bir suç olarak maddede öngörülen hareketlerden birinin gerçekleşmesini suçun işlenmesi için yeterli görmemekte fiilin sistematik ve belli bir süreç içinde işlenmesini aramaktadır. Nitekim, ilgili ihtisas dairesi sistematiklik kriterini pratiğe tercüme ederken birbiri ile çelişen kararlar vermekte ve her halükarda ‘sistematik’ kavramını açıklamakta zorlanmaktadır. Bu çalışmada geleneksel olarak işkence suçunu karakterize ettiği düşünülen acı ve ezanın ağırlığı kriteri ile öğreti ve uygulamanın benimsediği sistematiklik görüşü suç genel teorisi ve konu ile ilgili uygulama ışığında eleştirel bir biçimde ele alınmaktadır.ABSTRACT: Under the new Turkish Penal Code the actus reus element characterising the crime of torture according to prevailing opinion among legal doctrine is that the crime torture is necessarily of systematic and lasting nature. Based on the case law of the ECHtR and the definition stipulated in the UN Convention Against Torture, another opinion asserts that the severity of the pain is the distinctive criterion. Nevertheless, it must be said that both scholarly views adopt an interpretation that indeed contradicts the open letter of the provision on torture. Intriguingly, pursuant to the case law of the Court of Cassation the mere commission of those acts specified alternatively in the provision does not suffice to fall within the scope of the crime of torture. Instead, parallel with the prevailing opinion, the Court of Cassation is of the view that for a crime to be qualified as a torture it requires repeated commissions of the same or different conducts which continued for certain period of time. Unsurprisingly, in translating this approach into practice, the Court of Cassation holds contradictory judgements, and in any case, encounters the difficulty in defining the concept of systematic commission. In the light of the recent case law and the general theory of crime, this study assesses both views, which are considered to characterise the crime of torture in Turkish criminal law, critically.
