| dc.description.abstract | ABSTRACT: The law needs to be renewed in the face of developing technology and in line with the needs of the society. With the industrialization, as a result of fault liability leading to unfair results in certain situations, cases of faultless liability have come to the fore. Man employer's responsibility is one of them. In this study, the responsibility of the man employer regulated in the 66th article of the Turkish Code of Obligations which is one of the faultless responsibility situations has been examined. In this context, in the first part of the study that consists of four parts, after examining the cases of faultless responsibility in general, legal basis of man employer liability, comparison with similar liability cases and special appearance situations have been examined. In the second part, the elements of man employer liability, and in the third part, legal elements on this issue will be examined. In the last section, after examining the recourse conditions of liability, a conclusion will be made within the framework of the issues discussed in the study. | en_US |
| dc.description.abstract | ÖZET: Hukukun gelişen teknoloji karşısında ve toplumun ihtiyaçları çerçevesinde yenilenmesine ihtiyaç duyulmaktadır. Sanayileşme ile birlikte kusur sorumluluğunun belli bazı durumlarda hakkaniyetli olmayan sonuçlara yol açması neticesinde kusursuz sorumluluk halleri gündeme gelmiştir. Adam çalıştıranın sorumluluğu da bunlardan birisidir. Bu çalışmada da Türk Borçlar Kanunu’nun 66’ncı maddesinde düzenlenen ve kusursuz sorumluluk hallerinden biri olan adam çalıştıranın sorumluluğu incelenmiştir. Bu kapsamda dört bölümden oluşan çalışmada birinci bölümde kusursuz sorumluluk halleri genel olarak incelendikten sonra adam çalıştıranın sorumluluğunun hukuki dayanağı, benzer sorumluluk halleri ile mukayesesi ve özel görünüm halleri incelenmiştir. İkinci bölümde adam çalıştıran sorumluluğunun unsurları, üçüncü bölümde ise bu konudaki hukuki karineler incelenecektir. Son bölümde ise sorumluluğun rücu şartları incelendikten sonra da çalışmada tartışılan konular çerçevesinde bir sonuca varılmaya çalışılacaktır. | en_US |
