Özet
Örgütler, kişilerin haklarını ve menfaatlerini korumak için bir araya gelir. Örgütlenme özgürlüğü bireylerin ortak bir amaç için resmi ve gayri resmi gruplara katılıp ortak bir amaç için bir arada hareket etme hakkını ifade eder. Sendikalaşma özgürlüğü, örgütlenme özgürlüğünün özel bir yansımasıdır. Sendikalaşma özgürlüğüne ve onun vazgeçilmez unsurları olan toplu iş sözleşmesi hakkı ile grev hakkına gerek ulusal gerekse uluslararası düzenlemelerde yer verilmiştir. Uluslararası sözleşmelere, Uluslararası Çalışma Örgütü (ILO) denetim organları kararlarına ve Avrupa İnsan Hakları Mahkemesi (AİHM) içtihatlarına göre, sendikalaşma özgürlüğünün Anayasa ve yasalarda açıkça düzenlenerek teminat altına alınması gerekir. İşçilerin örgütlenme özgürlüğünün korunması, insan hakları ve kurumsal sosyal sorumluluk taahhütlerinin çok önemli bir yönüdür. İşçiler ve işverenler, uluslararası hukukta ve şirket taahhütlerinde belirtildiği gibi, kendilerini temsil eden örgütler kurma ve bunlara katılma hakkına sahiptir. Ancak, işçilerin örgütlenme özgürlüğü, işveren müdahalesi veya yetersiz yasal korumalar sonucunda engellenebilir.
Organizations are the institutions which come together in order to protect the rights and the interests of people. Freedom of association expresses the individuals' right to join an official or unofficial group and act together for a common goal. Freedom to form unions is a special reflection of freedom of association. Freedom to form unions and its indispensable parts, the right of collective bargaining agreement and the right to strike, are mentioned both in international and national regulations. It is required to secure the freedom to form unions in the constitutions and the laws by transparently regulating them in accordance with the international contracts, the decisions of International Labour Organization (ILO) auditing organs, and the case laws of European Court of Human Rights. Protecting workers' freedom of association is a crucial aspect of human rights and corporate social responsibility commitments. Employers and workers have equal rights in forming and joining organizations to represent themselves as it is specified at the company pledge. However, the workers' freedom of association can be blocked by the interference of the employers due to the insufficient legal protection.
