Özet
Sosyal statü ve toplumsal cinsiyet dinamiklerinin gündelik hayatı yönettiği küçük bir Osmanlı köyünde, 8 Şubat 1866'da bir adam gizemli bir şekilde öldürüldü ve karısı Ümmügülsüm 1 Haziran 1867'de cinayete ortak olmaktan mahkûm edildi. Bu tez, 19. yüzyıl Osmanlı İmparatorluğu'nda adaletin uygulanmasında toplumsal cinsiyet normları ve yasal reformların iç içe geçmiş yollarına odaklanarak bu cinayetin tarihsel bağlamını ve yansımalarını araştırmaktadır. Tanzimat döneminde Osmanlı hukuk sisteminde yaşanan dönüşümü inceleyen bu çalışma, gelişen hukuki uygulamalar ile yerleşik toplumsal cinsiyet önyargıları arasındaki karmaşık dinamikleri ortaya koymaktadır. Mahkeme kayıtları ve sorgu tutanaklarının detaylı analizi yoluyla araştırma, kadınların suçluluğuna ilişkin toplumsal algıların hukuki sonuçları nasıl etkilediğini vurgulamaktadır. Araştırma, Tanzimat'ın hukuk sistemini modernleştirmeye yönelik reformlarına rağmen, geleneksel toplumsal cinsiyet rollerinin yargı süreçlerini ve kararlarını etkilemeye devam ettiğini savunmaktadır. Ümmügülsüm'ün davasını merkeze alan bu tez, sıradan Osmanlı kadınlarının failliğini daha geniş bir hukuki ve toplumsal değişim anlatısı içinde yeniden konumlandırarak, 19. yüzyıl Osmanlı İmparatorluğu'nda adalet, toplumsal cinsiyet ve reform hakkında incelikli bir anlayış sunmayı amaçlamaktadır.
Within a small Ottoman village, where social status and gender dynamics governed daily life, a man was mysteriously killed on 8 February 1866, and his wife, Ümmügülsüm, was sentenced to be an accomplice to the murder on 1 June 1867. This thesis explores the historical context and repercussions of this murder, focusing on the intertwined paths of gender norms and legal reforms in the application of justice in the 19th-century Ottoman Empire. By examining the transformation of the Ottoman legal system during the Tanzimat period, this study reveals the complex dynamics between evolving legal practices and entrenched gender biases. Through a detailed analysis of court records and interrogation protocols, the research highlights how societal perceptions of female criminality influenced legal outcomes. It argues that despite the Tanzimat reforms to modernize the legal system, traditional gender roles continued to impact judicial processes and decisions. By centering on Ümmügülsüm's trial, this thesis seeks to recenter the agency of ordinary Ottoman women within the broader narrative of legal and social change, offering a nuanced understanding of justice, gender, and reform in the 19th century Ottoman Empire.
