Abstract
01.01.2002 tarihi itibariyle hukukumuza giren 4721 sayılı Türk Medeni Kanunu, kendinden önceki kanun olan Türk Kanunu Medenisini ilga ettiği gibi ülkemizde büyük bir zihniyet değişikliğine de sebep olmuştur. Bu zihniyet değişikliğinin en temel örneklerinden biri bu esere de konu olan mal rejimleri konusunda olmuştur. Eski kanun dönemindeki arkaik ve patriarkal bakış, çağa uygun normlar ile bir nebze olsun kırılmış ve 4721 sayılı Türk Medeni Kanunu ile evlilik birliğinde eşler arasında ekonomik eşitliğin yolu açılmıştır. Ancak geldiği gün tartışıldığı gibi üzerinden geçen 20 senenin sonunda hala en çok tartışılan kanunlardan biri olmaya devam etmektedir. Bu durumun en önemli sebebi tüm diğer kanunların aksine toplumun istisnasız tamamını ilgilendiriyor olmasıdır. Bu sebeple bu tezde, hem Türk Medeni Kanunundaki yasal mal rejimini hem de seçimlik mal rejimlerini açıklamak ve bu rejimlerin benzer yönleri ile ayrık yönlerini ortaya koymak amaçlanmıştır. Bu kapsamda çalışmanın ilk bölümünde yasal mal rejimi olan Edinilmiş Mallara Katılma rejimi, ikinci bölümünde Mal Ortaklığı rejimi, üçüncü bölümde önceki kanun dönemindeki yasal mal rejimi olan Mal Ayrılığı rejimi ve dördüncü bölümde Paylaşmalı Mal Ayrılığı rejimi; kanunda yer alan bu rejimlerin benzer yönleri ile ayrık yönlerini ortaya koymak amacıyla incelenmiştir.
Entered in force as of 01.01.2002, the Turkish Civil Code numbered 4721 not only abolished the previous law, the Turkish Civil Code numbered 743, but also caused a major mentality change in the country. One of the fields where the reflection of this mentality alteration is most clearly observed is the subject of matrimonial property regimes, which is also the subject of this work. The archaic and patriarchal view of the old law period was broken to some extent by the norms suitable for the age, and the way for economic equality between the spouses in the marriage union was opened with the Turkish Civil Code No. 4721. However, as it was discussed on the day it came, it still remains one of the most discussed laws at the end of the last 20 years. The most important reason for this situation is that unlike all other laws, it concerns the entire society without exception. For this reason, in this thesis, it is aimed to explain both the legal property regime in the Turkish Civil Code and the optional property regimes and to reveal the similar and discrete aspects of these regimes. In this context, in the first part of the study, the legal property regime as The Regime of Participation in Acquired Property, in the second part of the The Regime of Community of Property, in the third part of The Regime of Separation of Property, which is the legal property regime in the previous law period, and in the fourth part, The Regime of Shared Separation of Property; these regimes in the law have been examined in order to reveal their similar and discrete aspects.
