İfade özgürlüğü bağlamında terörle mücadelede görev almış kamu görevlisinin hüviyetinin açıklanması, yayınlanması ve hedef gösterilmesi suçu (TMK m. 6/1)

Abstract

Terörle Mücadele Kanunu, yürürlüğe girdiği tarihten başlayarak 6, 7 ve 8. maddeleriyle ifade ve basın özgürlüğünü sınırladığı yönünde eleştirilere konu olmuştur. Bu suçlardan birisi de ise 6. madde 1. fıkrada düzenlenen "terörle mücadelede görev almış kamu görevlisinin hüviyetinin açıklanması, yayınlanması ve hedef gösterilmesi" suçudur. Düzenleme, yasa görüşmelerinden başlayarak terörle mücadelede görev almış kamu görevlilerinin başta işkence olmak üzere hukuka aykırı fiillerine dair haber yapılmasını engelleyeceği ve bireylerin hak arama hürriyetlerini kısıtlayacağı endişesiyle tartışmalara yol açmıştır. Suç, açıklama, yayınlama ve hedef gösterme türünden büyük ölçüde basın yoluyla gerçekleşebilecek fiilleri cezalandırmaktadır. Bu nedenle başta "terör" ve "hedef gösterme" tanımının belirsizliği ve soyut tehlike suçu olması bakımından, TMK m. 6/1, basın ve ifade özgürlüğü ile çatışma halindedir. Bu kapsamda çalışmamızda, suçun unsurları bakımından incelemesi yapılarak Anayasa'ya aykırılıkları tespit edilecektir.Anti-Terror Law No. 3713 has been criticised for limiting the freedom of the press and expression with Articles 6, 7 and 8 on crimes committed through the press starting from the date of its entry into force. One of these crimes is the crime of "disclosure, publication and targeting of the identity of a public official who took part in the fight against terrorism", which is regulated in paragraph 1 of Article 6. The regulation led to discussions with the concern that it would prevent reporting on illegal acts, especially torture, by public officials who took part in the fight against terrorism, starting with the law negotiations, and would restrict the freedoms of individuals to seek their rights. The crime conflicts with freedom of the press and expression. It punishes acts such as disclosure, publication and targeting that can be committed largely through the press, the vagueness of the definition of "terrorism" and "targeting" and the fact that it is an abstract endangerment crime. Within the scope of our study, a comprehensive examination of the crime will be carried out and violations of the Constitution will be determined.
