Edebiyat ile insanı görmek: Jean Genet ve ötekiden ötekileştirmeye giden yol

Abstract

ÖZET: “Edebiyat ile İnsanı Görmek: Jean Genet ve Öteki’den Ötekileştirmeye Giden Yol” adlı bu çalışma, yaşanan hak ihlallerinde insanı anlamak ve görmek için sadece hukukun yeterli olamayacağı ve edebiyatın söz konusu görmeyi destekleyip hukukun değişimine katkı sunacağı konusundaki görüşten temellenmiştir. Bu çerçevede hukuk - edebiyat araştırmaları içerisinde insanın ontolojik olarak mutlak ihtiyaç duyduğu öteki ile ilişkisinin hangi koşullarda ötekileştirmeye ve bir insan hakları ihlali olan ayrımcılığa döndüğü irdelenmeye çalışılmıştır. İlk bölümde hukuk ve edebiyatın ortak, ayrışan ve destekleyici noktaları ele alınırken, ikinci bölümde ise “aykırı” yazar Jean Genet’nin yaşamı, politik duruşu ve ilgili eserleri eşliğinde öteki, tanınma, aidiyet ve ötekileştirme kavramlarının tekrar düşünülmesi amaçlanmıştır. Son bölümde ise yazarın Hizmetçiler ve Balkon adlı oyunlarında cinsel yönelim kapsamında gerçekleşen ötekileştirme ve iktidar ilişkileri değerlendirilmiş, ötekileştirmenin çok boyutları sebepleri ve sonuçları metin analizleri üzerinden gösterilmeye çalışılmıştır. Tez çalışması, disiplinler arası bir yaklaşımla insanın yaşadıklarının hukuksal süreçlerin ötesinde sosyal, politik ve bireysel anlamda edebiyat ile bütünsel olarak algılanabileceği ve edebiyatın hukukun gelişmesinde belirgin bir rolü olduğu anlayışını taşımaktadır.ABSTRACT: This study, titled “Regarding Human with Literature: Jean Genet and The Way Through Other to Otherness” is based on the view that the effects on the violations of rights cannot only be comprehend by law since literature can root for the change and progress for law. In this frame, within the studies of law and literature it has been tried to evalute on which social, political and individual terms the absolute ontological need of relation with other turns to otherness that creates discrimination which is a violation of human rights. This study is made up with three sections. In the first section, the common, distinctive and supportive features of the relation between law and literature is studied and argued. The second section tries to envisage space for rethinking the notions and the topics of other, otherness, recognition, belonging within the view of the “marginal” author Jean Genet, his life, his politicial position and related plays. The textual comparative axis of this study is Genet’s two plays titled The Maids and The Balcony. In the last section, reflections of otherness in sexual orientation tried to discussed in these related emphasised plays. This thesis aims to give a holistic and interdisciplinary point of view that while violation is widespread, literature may be significant to help law to develop.
