| dc.description.abstract | Bu çalışmayı hazırlarken edebiyatla hukukun hayata dair şeyler oldukları gerçeğinden hareketle hukuk ve hukukçu için edebiyatın önemini anlatmaya çalıştık. Bununla birlikte çalışmamıza başlarken ilk bölümü Kafka' nın geleceği öngörme yetisini anlatabilmek bakımından da yardımcı olacağı düşüncesiyle tarihsel süreç incelemesine ayırdık. Çalışmamızın ikinci bölümünde ise, o tarihsel sürecin iktidarın konumunu nasıl belirlediğini ve geleceğe nasıl inşa edilmiş bir toplum bıraktığını ve sürecin insanlığı nereye götürdüğünü Kafka ekseninde irdelemeye çalıştık. Son bölümde ise yine Kafka'nın penceresinden bakmaya çalışarak, bir hukuk ve adalet analizi yapmadan önce, genel anlamda bir hukuk ve adalet teorisine değinerek, Kafka'nın özellikle cezalandırıcı adalet anlayışının sakıncalarını nasıl gözler önüne serdiğini anlatmak istedik. | en_US |
| dc.description.abstract | This study aims to emphasize the importance of literature for law and lawywers, originated from the fact that law and literature are the parts of real life. Our study consists of three parts. It was aimed to analyze the historical period to show the ability of Kafka of foreseeing the future in the first chapter. In the second part, it was aimed to emphasize - on Kafka's axis -, how the historical period determined the position of power and where it will take and bring the humanity. Finally, in the last chapter, again through Kafka's point of view, this paper aims to analyze law and justice after mentioning to the general theory of law and justice and after underlining Kafka's thoughts of retributive justice is problematic and how idea of punishment takes the community to dangerous and undesirable edge. | en_US |
