| dc.description.abstract | During the Second World War, after the state's being accepted as the highest asset and the personal rights of the individuals were damaged, the arrangements that gave importance to the individual were given. Since the right to personality is not defined in the law, the determination of personality rights is left to practice and doctrine. Therefore, these values will change continuously according to the moral, social, cultural, economic and technological situation of the person and the time and conditions in which such developments take place. In practice, cases concerning the right to personality often arise from the personality values that we examine in our study, but there are exceptions. | en_US |
| dc.description.abstract | İkinci dünya savaşı sırasında devletin en yüksek varlık olarak kabul edilmesiyle bireylerin kişilik haklarının zarar görmesinin ardından batılı devletler kişiye önem veren düzenlemelere yer verilmiştir. Kişilik hakkının nelerden ibaret olduğu kanunda tanımlanmadığından, kişilik haklarının tespiti uygulamaya ve doktrine bırakılmıştır. Bu nedenle bu değerler kişinin içinde bulunduğu ahlaki, toplumsal, kültürel, ekonomik ve teknolojik duruma ve bu tür gelişmelere bağlı olarak zamana ve içinde bulunduğu koşullara göre sürekli olarak değişebilecektir. Uygulamada kişilik hakkına ilişkin davalar genellikle çalışmamızda incelediğimiz kişilik değerlerinden kaynaklanmakta ise de istisnaları da mevcuttur. | en_US |
