Adi konkordatonun tasdikinin etkileri ve sonuçları

Abstract

ÖZET: Konkordato, borçlarını ödemekte zorlanan borçlunun borçlarını ifa etmesine ve ekonomik faaliyetini sürdürmesine imkan verirken, alacaklıların da alacaklarını, borçlunun iflâsına göre daha avantajlı şekilde tahsil etmelerini sağlayan bir kurumdur. Borçlarını ödeyebilmek için bir proje hazırlayan borçlu, konkordato talebiyle mahkemeye başvurur. Kanunda sayılan şartların yerine getirilmesi halinde borçlunun konkordatosu tasdik edilir. Borçlunun tasdik edilen konkordato projesi uyarınca borçlarını ifa etmesi ve böylece konkordatonun başarıya ulaşması için tasdik kararıyla birlikte konkordatonun birçok etki ve sonucu ortaya çıkar. 28.02.2018 tarihli 7101 sayılı İcra ve İflâs Kanunu ve Bazı Kanunlarda Değişiklik Yapılması Hakkında Kanun ile Türk Hukuku’nda konkordato kurumu baştan sona yenilenmiştir. Dolayısıyla yürürlükte olan hükümler kapsamında konkordatonun tasdikinin yarattığı etki ve sonuçlarla ilgili öğretide birçok tartışma ve görüş bulunmaktadır. Çalışmamızda, konkordatonun tasdikinin, konkordato projesi uyarınca ifa edilecek borç ve alacaklar ile konkordatoya başvuran borçlu ve alacaklılar üzerinde yarattığı etkiler ve sonuçlar incelenmiş, bu konuda öğretideki görüşlere yer verilerek değerlendirme yapılmıştır.ABSTRACT: Concordat is an institution that allows the debtor, who has difficulty in paying their debts, to fulfill their debts and continue their economic activity, while enabling the creditors to collect their receivables more advantageously than the debtor's bankruptcy. The debtor, who prepares a project to pay their debts, applies to the court with a request for a concordat. If the requirements stipulated in the law are fulfilled, the concordat of the debtor is approved. Many effects and consequences of the concordat arise with the approval decision, in order to the debtor to fulfill their debts in accordance with the approved concordat project and thus the concordat to be successful. With the Law numbered 7101 dated 28.02.2018 on Amendment in Enforcement and Bankruptcy and Some Laws, the institution of concordat in Turkish Law has been completely renewed. Therefore, within the scope of the provisions in force, there are many discussions and opinions in the doctrine about the effects and consequences of the approval of the concordat. In our study, the effects and consequences of the approval of the concordat on the debts to be performed in accordance with the concordat project, the receivables, the debtor who applied for the concordat and creditors were examined, and an evaluation was made by giving place to the views in the doctrine.
