The effects of the European Union family reunification directive on transnational couples: The family reunification visa process from Türkiye to Germany and the impact of the Covid-19 pandemic

Özet
Bu çalışma, Avrupa Birliği aile birleşimi direktifinin 2003 yılında sonuçlandırılarak 2005'de yürürlüğe girmesinden ardından direktifi araçsallaştırarak sınır politikalarını zorlaştıran Federal Almanya Hükümeti'nin göç politikalarının ulusötesi evlilikler üzerindeki etkilerini ve evlilik göçünü sürecindeki koşullandırmanın göç sürecine yankılarını incelemektedir. COVID-19 pandemisinin ardından küresel hareketliliğin yavaşlaması ile birlikte evlilik göçü üzerindeki belirsizliklerin Türkiye'den Almanya'ya göç sürecinde olan eşlerin süreçlerini nasıl etkilediği geliştirdikleri başa çıkma mekanizmalarını ortaya koymayı hedeflemektedir. Çeşitli derinlemesine görüşmeler sonucunda toplanacak veriler ile birlikte Türkiye'den göç sürecinde olan eşlerin yaşadıkları zorlukları, vize sürecinin evlilikleri üzerindeki etkileri, direktifin dayandırdığı idari ve yasal gereklilikleri yerine getirmeye çalışırken edindikleri tecrübeleri ve başa çıkma mekanizmalarını değerlendirerek, sınır politikalarının evlilikler üzerindeki etkilerini eleştirisel bakış açısı ile ortaya koymaktayım. Anlatılar, dilbilgisi şartı gibi yasal gerekliliklerin evlilik göçü sürecini önemli oranda etkilediğini ve bireylere farklı sorumluluklar ve baskılar yüklediğini, bunun da evliliklerin dinamiklerini etkilediğini açıkça ortaya koymaktadır. Bunun yanısıra, COVID-19 pandemisinin başlangıcından itibaren anormal şekilde uzayan vize başvuru süreçleri Alman hükümetinin evlilik göçü üzerindeki tutumlarına dair olumsuz bir tablo ortaya koymaktadır. This study analyzes the effects of the migration policies of the Federal Government of Germany—which has made border policies more difficult by instrumentalizing the European Union family reunification directive that was finalized in 2003 and became effective in 2005—on transnational marriages and the repercussions of the conditionality of marriage migration on the migration process. In the context of reduced global mobility following the COVID-19 pandemic, the study aims to reveal the impact of the uncertainties on the marriage migration processes of spouses migrating from Turkey to Germany and the coping mechanisms they have developed. With data collected through various in-depth interviews, I aim to analyze the difficulties experienced by spouses during the migration process from Turkey, the effects of the visa process on their marriages, and their experiences and coping mechanisms while trying to fulfill the administrative and legal requirements of the directive, and I evaluate the effects of border policies on marriages from a critical approach. The narratives explicitly reveal that legal requirements of marriage migration, such as primary language requirements significantly affect the marriage migration process and impose various responsibilities and pressures on spouses, which in turn affect the dynamics of marriages. In addition, since the beginning of the COVID-19 pandemic, extraordinarily lengthy visa application processes reflect a negative image of the German government's attitudes toward marriage migration.
