Özet
ÖZET: Asıl işveren alt işveren ilişkisinde rücu, çalışmamızın konusudur. Asıl işveren, alt işveren işçisinin işçilik alacaklarından kanunen müteselsil sorumludur. Müteselsil sorumluluğun getirdiği dış ilişkiden kaynaklı borcun ifası sonrasında iç ilişki devreye girmektedir. Kendisine düşen paydan fazla ifada bulunan borçlunun ödediği fazla miktarı diğer borçlulardan talep etme hakkı bulunmaktadır. Çalışmamız iki bölümden oluşmaktadır. Birinci bölümde asıl işveren alt işveren ilişkisinin unsurları, müteselsil sorumlulukla ilgili borçlar hukukunda yer alan düzenlemeler ve asıl işveren alt işveren ilişkisindeki müteselsil sorumluluğun yapısı incelenmiştir. Çalışmanın ikinci bölümünde rücu hakkı detaylı olarak açıklanmıştır. Borçlar hukuku temelinde rücu kavramı ve özellikleri ikinci bölümde öncelikli olarak ele alınmıştır. Asıl işveren alt işveren ilişkisinde bir hukukî ilişkiye iki farklı kanun uygulanmaktadır. Asıl işveren ve alt işveren arasındaki atipik çalışmanın sonucu dikkate alınarak rücu hakkı tüm aşamaları ile taraflar yönünden değerlendirilmiştir. İş davaları iş mahkemelerinde görülmektedir. Buna karşılık asıl işveren alt işveren arasındaki rücu davaları asliye hukuk mahkemeleri veya asliye ticaret mahkemelerinde görülür. Bu durum uygulamada çelişkili kararların verilmesi sonucunu doğurmuştur. Çalışmamız kapsamında çelişkili kararlar incelenmiş ve çözüm önerilerimiz sunulmuştur. Son olarak da kanuna aykırı asıl işveren alt işveren ilişkisinde rücu konusu incelenmiştir.
ABSTRACT: Recourse between principal employer and subcontractors is the subject of this study. Principal employer shall be jointly and several liable with the subcontractor for the debts of employees by law. After performing obligation to employee in regard with joint and several liability regulations, recourse between debtors initiated. Debtor who perform more than his share shall be entitled to demand the amount he paid more than his share from other debtors. The study consist of two sections. In section one; conditions of principal employer and subcontractor relationship, legal steps of joint and several liability under law of obligations and joint and several liability between principal employer and subcontractor is reviewed. Second section of the study clarifies right to recourse in detail. Concept and feature of recourse is considered on a preferential basis in the second section under law of obligations. Two different acts enforced to principal employer and subcontractor relationship. As a result of atypical work between principal employer and subcontractor, entire provisions of right to recourse evaluated in terms of obligors. Employment cases of workers shall be heard in labor courts. On the other hand, recourse disputes between principal employer and subcontractors shall be heard in civil courts of general jurisdiction or basic commercial courts. As a result, conflicted decisions rendered by courts in practice. The study evaluated conflicted jurisprudence and proposed solutions. Recourse between unlawful principal employer and subcontractor relationship examined in conclusion.
