| dc.description.abstract | Modern devlet ve hukuk kuramlarında, yargılama ve cezalandırmayı tekelinde tutan devletin kendisidir. Hukuk devletinin bireylerin güvenliğini sağlamak açısından en önemli yükümlülüklerinden biri de, hukukun sekteye uğramadan uygulanmasını tesis etmektir. Oysa kitlesel şiddet, hukukun yargılama tekelini hiçe sayar. Bu tezde, özellikle cezalandırma amacıyla uygulanan toplumsal şiddet olarak linç ve hukuk kuramlarındaki yeri incelenmiştir. Karşılaştırmalı olarak ceza kanunlarında linçin suç olarak tanımlarına bakılmış, konu hakkında yapılmış çalışmalar ışığında linçin genel bir çerçevesi çizilmeye çalışılmıştır. | en_US |
| dc.description.abstract | In the modern theories of state and law, it is the state itself that holds the power of judgement and punishment. One of the most important obligations that a state of law must meet is to establish the uninterrupted practice and presence of law. However, collective violence flouts the law and its monopoly of jurisdiction. In this thesis, lynching as a collective violence, especially when applied on the purpose of punishment is examined. Different criminal law systems and legislations are compared. A general definition of lynching is tried to be given in thelight of the previous work on this subject. | en_US |
