İnsan hakları ekseninde internetin kontrolü ve hukuki sorumluluk rejimi

Abstract

Özet: İnternet, küresel bir bilgiye erişim ve iletişim ağıdır. İnternet, her geçen gün büyümekte; sosyal, ekonomik, kültürel, siyasi veya ticari amaçlarla kullanılmaktadır. Bireysel kullanımın yanı sıra kamu hizmetlerinin sunumunda da artık varsayılan mecra internet olmuştur. İnternet ortamında sınıflandırılması neredeyse mümkün olmayan çeşitlilik ve boyutta içerik barındırılmaktadır. Bu içerikler, önceden belirlenmemiş güzergâhlarla ağda dolaşıma girmekte ve ülkelerin sınırlarını sadece saniyeler içinde aşmaktadır. Benzeri görülmemiş derecede büyük, dağıtık ve kendine özgü teknik yapısı olan, çok farklı egemenlik alanlarını, kurumları ve kişileri ilgilendiren bir yapının nasıl düzenleneceği hem ulusal hem de uluslararası hukukun en temel meselelerinden biri hâline gelmiştir. Bilhassa internetin kontrolünün ve internet ortamındaki içerikten sorumluluğun nasıl olacağı güncel bir sorun olarak belirmiştir. Nihayetinde, internetin kullanım alanlarının genişlemesi ve interneti kullanan kişi gruplarının çeşitlenmesi sebebiyle aynı anda birden çok hakkın etkilenmesi, kısıtlanması ve hatta özüne dokunulması kaçınılmaz olmaktadır. Bu makale, internetin kontrolü ve internet ortamında hukuki sorumluluk meselelerini insan hakları ekseninde incelemektedir. Makalede, Avrupa Konseyinin internete ilişkin tüm deklarasyonları ve tavsiye kararları ile Avrupa İnsan Hakları Mahkemesinin (AİHM) internetle ilgili tüm kararları genel hatlarıyla incelenmektedir. Makalede internet ortamındaki içeriğe erişimin engellenmesi, içeriğin kaldırılması, internet ortamında kişilik haklarının korunması, internet platformlarının hukuki sorumluluğu, unutulma hakkı, üçüncü kişilere ait internet içeriğinden sorumluluk ve üçüncü kişilere ait internet bağlantılarından sorumluluk konuları ele alınmaktadır. Bu doğrultuda, AİHM’in kararları ışığında ideal bir internet yasasının nasıl olması gerektiği sorusunun yanıtı bulunmaya çalışılmaktadır.Abstract: The Internet is a global information and communication network. The expansion of the Internet has been continuing to grow, and this network is being used for various social, economic, cultural, political, or commercial purposes. Besides individual use, the Internet has evolved into being a default medium for delivering public services. The unlimited variety and diverse size of content, which is almost impossible to classify, is currently hosted on the Internet. These contents circulate on the network via unfixed routes, and they cross the borders of the countries only within seconds. Regulating an extensive, distributed network with a unique technical structure that concerns diverse sovereignty areas, institutions, and individuals has become one of the most crucial national and international law issues. In particular, the Internet’s control and online content responsibility have emerged as a contemporary problem. Ultimately and inevitably, various fundamental rights are affected, restricted, and their essence is touched at the same time because of the expansion of the usage areas of the Internet and the diversification of the groups of people using the Internet. This article examines the issue of control of the Internet and matters rotating around legal liability in the online ecosystem in the context of human rights. Within the article, all the declarations and recommendations of the Council of Europe and all the ECtHR decisions regarding the Internet are examined in general terms. This article evaluates the blocking of access to the internet content, the removal of content, the protection of personality rights on the Internet, the legal responsibility of online platforms, the right to be forgotten, the responsibility for digital content belonging to third parties and to third-party internet links. In this context, the article attempts to answer how an ideal internet law should be formed in the light of the ECtHR jurisprudence
