Özet
Bu çalışma, bir insan hakkı olarak su hakkının dünyadaki gelişimi ve Türkiye Sineması'nda su mülkiyeti üzerinden su hakkını işleyen Susuz Yaz sinema filmini irdelemeyi amaçlamaktadır. Su hakkının bir insan hakkı olarak ele alındığı Susuz Yaz filminin ve bir insan hakkı olarak su hakkı konularının ortak bir çalışmada yer almasının sebebi, su mülkiyeti üzerinden su hakkının ve ayrıca su hakkının birçok insan hakkıyla bağlantılı olması ve ihlalleri doğrultusunda doğrudan insanı hedef almasıdır. İhlallerin oluşmasına nelerin sebep olduğu, su üzerine hangi politik kararların alındığı, iktidar biçimleri tarafından suyun insan hakkından, ticari bir metaya dönüşme sürecinde ne tarz insan hakkı ihlallerine yol açtığı ve açmakta olduğu, su mülkiyeti, özelleştirmeler ile susuzluk arasındaki doğrusal denklem göz önüne alınmıştır. Susuz Yaz filmi ile irdelenen su hakkı ve su gaspının, toplumda yol açtığı durumlar ortaya konmaktadır. Sinema ve hukuk ilişkisi üzerinden Susuz Yaz filmi, sadece toplumsal bir araç olarak değil politik bir araç olarak da ele alınacaktır. Bu film sayesinde insan hakları ihlallerinin gelişiminin suya ve su mülkiyetiyle bağlantısı gözler önüne serilecektir. İki ana başlıktan oluşan bu çalışmada öncelikle su, suyun özellikleri, toplumsal ve dünyamız için ihtiyaç durumu, ortak miras olması ve su hakkının bir insan hakkı olarak gelişiminin tarihi süreci, uluslararası metinlerdeki yeri, ilgili sözleşmeler ve suyun metalaşmasını destekleyen başlıca uluslararası kuruluşların incelenmesiyle aktarılacaktır. Daha sonra da sinema ve insan hakları bağlamında Metin Erksan'ın Susuz Yaz filmi incelenecek, film okuması yapılacak, su hakkının insan haklarıyla ilişkisi, su mülkiyetinin yol açtığı ihlallerin oluşturduğu toplumsal süreç ve dünya sinemasından su temalı filmlerin örnekleri ile ele alınacaktır.
This study aims to examine the development of water right, as a human right, in the world and the movie "Susuz Yaz" discussing the water right upon water ownership in Turkish Cinema. The reason of the movie "Susuz Yaz" where the water right is discussed as a human right and issues of water right as a human right being found in a common study is that the water right upon water ownership and, separately, the water right is related to lots of human rights and that incase of any violation, those directly target the human. The linear equation in between the reasons of violation, political decisions taken related to the water, human right violations in the process of the water being transformed to a commercial meta from being a human right, by forms of power; water ownership, privatization and lack of water are taken into consideration. Circumstances resulted from the water right and water extortion discussed with the movie "Susuz Yaz" are presented. The movie "Susuz Yaz" will not only be taken into account as a social instrument, but also as a political instrument through the relation of the cinema and law. By means of this movie, the connection in between the development of human rights violations with the water and water ownership will be presented. First of all; water, properties of water, its social status and the need for that all over the world, water being the common heritage and historical development of water right as a human right, its place in international texts, related contracts and examination of primary institutions supporting commodification of water will be mentioned in this study composed of two main chapters. And then, the movie of Mr. Metin Erksan, "Susuz Yaz" will be discussed in terms of cinema and human rights, movie reading will be made and the relation in between the water right and human rights, social process resulted from violation of water ownership will be examined with examples of movies related to the water, from all over the world.
