dc.description.abstractÇalışma kapsamında ekonomik suç olarak değerlendirilen fiyatları etkileme suçu incelenmektedir. İlgili suç ekonomik suç kapsamında olduğu için çalışmada ekonomik suçlara ilişkin değerlendirmeler yapılmaktadır. İnceleme konusu suç pratikte nadiren uygulama alanı bulmaktadır. Fakat her ne kadar pratikte uygulama alanı bulmasa da bu suç kullanılmasının gerekebileceği zamanlar için bir köşede hazırda tutulmaktadır. En son 6 Şubat 2023 tarihinde ülkemizde yaşanan ve Kahramanmaraş, Gaziantep, Urfa, Diyarbakır, Adana, Adıyaman, Osmaniye, Hatay, Malatya ve Elazığ şehirlerini etkileyen depremde olduğu gibi özel bir önem kazanmaktadır. Suçun pratikte uygulama alanı bulamamasının yanı sıra ilgili suç kapsamlı bir çalışmaya da konu olmamıştır. Deprem, sel, heyelan gibi doğal afetlerin sıklıkla yaşandığı doğal afetler bağlamında önemi açık bir şekilde ortaya çıkan bu suçun unsurlarının öğretide nispeten az ilgi görmesi şaşırtıcıdır. Bu çalışma hem konunun doğal afet bağlamındaki bu boyutunun altını çizmekte hem de inceleme konusu suçların unsurlarına ilişkin tartışmaya mütevazi bir katkı koymayı amaçlamaktadır. Çalışmamızda fiyatları etkileme suçunun unsurlarını pratikte karşımıza çıkabilecek örneklerle inceleyeceğiz.
dc.description.abstractWithin the scope of the study, the crime of influencing prices, which is considered as an economic crime, is examined. Since the relevant crime is within the scope of economic crimes, evaluations regarding economic crimes are made in the study. The crime under examination is rarely applied in practice. However, although it does not find practical application in practice, this crime is kept ready in a corner for when it may be necessary to use it. It gains special importance, as it did during the earthquake in our country on February 6, 2023, which affected the cities of Kahramanmaraş, Gaziantep, Urfa, Diyarbakır, Adana, Adıyaman, Osmaniye, Hatay, Malatya and Elazığ. In addition to the lack of practical application of the crime, the crime has not been the subject of a comprehensive study. It is surprising that the elements of this crime, the importance of which clearly emerges in the context of natural disasters such as earthquakes, floods and landslides, which are frequently experienced, have received relatively little attention in the doctrine. This study aims both to underline this dimension of the issue in the context of natural disasters and to make a modest contribution to the discussion on the elements of the offenses under review. In our study, we will examine the elements of the offense of influencing prices with examples that we may encounter in practice.
