The trial of the 49ers and its impact on the Kurdish movement

Bu tez, 17 Aralık 1959 tarihinde öğrenciler, avukatlar, gazeteciler ve rütbeli askerler gibi çeşitli mesleklerden 50 Kürt'ün; casusluk, bölücülük ve millî duyguları zayıflatma suçlamalarıyla tutuklandığı ve idam istemiyle yargılandığı 49'lar Davası'na odaklanmaktadır. Dava, 1958 Devrimi'nin ardından Barzani'nin Irak'a dönüşü, dünya genelinde yükselen sömürgecilik karşıtı hareketler ve Türkiye'nin yaşadığı iç siyasi bunalım gibi çeşitli bölgesel ve küresel gelişmelerin etkisiyle şekillenmiştir. 49'lar yaklaşık bir yılın ardından 1961 yılında serbest bırakılmış olsalar da dava süreci yaklaşık on yıl daha devam etmiştir. Bu dava, 1938'de bastırılan Dersim İsyanı'nın ardından Kürt milliyetçiliği suçlamasıyla açılan ilk davadır. Tutuklanan bazı isimler, 1960'larda yükselişe geçen Kürt hareketinin hem solcu hem de milliyetçi kanatlarında öncü roller üstlenmişlerdir.

This thesis focuses on the trial of the 49ers, in which 50 Kurds from different backgrounds and classes, such as students, lawyers, journalists, and ranked soldiers, were arrested on December 17, 1959, on charges of espionage, separatism, and undermining national sentiments, and prosecuted with demands for the death penalty. The trial was shaped by several regional and global developments, including the return of Barzani to Iraq after the 1958 revolution, the rise of postcolonial movements worldwide, and the internal political turmoil in Türkiye. Even though almost all the 49ers were released by 1961 after spending a year in prison, the legal process continued for a decade. This case was the first trial on charges of Kurdish nationalism since the prosecutions that followed the suppression of the Dersim Rebellion in 1938. Several imprisoned individuals would later play pioneering roles in both the leftist and nationalist wings of the Kurdish movement that gained momentum in the 1960s and onward.
