Sivil toplumun hapishanelere erişimi ve hak ihlallerine etkisi

Abstract

Bu tez çalışmasında Türkiye'de siyasi kırılmalarda sivil toplumun daralan alanı ile hapishanelerdeki hareket alanının nasıl kısıtlandığı analiz edilmiştir. Hapishanelerin sivil topluma kapalı hale gelmesi ve bu durumun içeride yaşanan hak ihlallerini nasıl tetiklediği incelenmiştir. Araştırmanın temel amacı, bu ikisi arasındaki ilişki üzerinden ihlalleri kamuoyuna duyurmak ve sivil toplum kuruluşlarını harekete geçirmektir. Araştırma bulguları, hapishanelerin otoriterleşen rejim tarafından sivil toplumdan izole edilmesiyle artan hak ihlalleri arasında bir ilişki olduğunu göstermektedir. 2013-2023 yılları arasında Türkiye'de hapishanelerde yaşanan hak ihlalleri ve sivil toplum erişimini kısıtlayan uygulamalar, hapishane alanındaki sivil toplum örgütlerinde çalışan katılımcılar ve bu sivil toplum örgütlerinin sayısal verileri üzerinden nitel ve nicel araştırma yöntemleri ile analiz edilmiştir. Sonuç olarak, hapishane gibi kapalı mekânlarda sivil toplumun denetimi ve gözetimi azaldıkça, işkence ve kötü muamele gibi hak ihlalleri artmaktadır. Çalışma, hapishanelerdeki hak ihlallerine karşı sivil toplumun sesini yükseltmenin ve bu ihlalleri önlemek için acil adımlar atmanın önemini vurgulamaktadır. Sivil toplumun hapishanelere erişiminin sağlanmasının ve bu alanlarda insan hakları ihlallerinin bağımsız kuruluşlar tarafından izlenmesinin hayati önem taşıdığı vurgulanmaktadır.

This thesis examines how the shrinking space for civil society and the restricted movement within prisons during political fractures in Turkey have been analyzed. It explores how prisons becoming inaccessible to civil society has triggered human rights violations inside these institutions. The primary aim of the research is to highlight these violations through the relationship between these two aspects and to mobilize civil society organizations. The research findings indicate a correlation between increased human rights violations and the isolation of prisons from civil society by an authoritarian regime. The study analyzed human rights violations in Turkish prisons between 2013 and 2023 and the practices restricting civil society access through qualitative and quantitative research methods involving participants working in prison-related civil society organizations and statistical data from these organizations. In conclusion, the study demonstrates that as oversight and supervision by civil society in closed environments like prisons decrease, incidents of torture and ill-treatment increase. It emphasizes the importance of raising the voice of civil society against human rights violations in prisons and taking urgent measures to prevent these abuses. Ensuring civil society access to prisons and monitoring human rights violations in these areas by independent organizations is highlighted as crucial.
